In August 2019, the 40th Ward office received notice of a zoning change request filed at 5136-5138 N Claremont St.
Following our community-driven zoning process, in which residents overwhelmingly opposed a three-unit development and expressed a desire that Claremont remain single-family zoned on the 5100 block, we determined that the Ward office could not support the change as proposed. At our request, the Zoning Committee deferred the matter.
The Zoning Committee has now received an amended proposal, responding to the community feedback, which would replace the initially-proposed three-flat development with a 2-story, 2800 sq. ft. single-family home. The new home would be constructed on a 25’10″x125′ lot designated 5136 N Claremont St., leaving the pre-existing three-story building on a 30’2″x125′ lot at 5138 N Claremont St.

Because the proposal must provide compliance for the existing three-flat building, the amended proposal requests a zoning change from RS-3 to RM-4.5. My office has requested that this be submitted as a Type 1 zoning change, which would tie the zoning change to the submitted plans at both lots. No other construction could be undertaken on the site in the future without a new zoning change, even if that construction would otherwise be zoning-compliant.
We expect the revised proposal to be submitted at the 2/13/2020 meeting of the Zoning Committee, held at 10:00am in City Council chambers at City Hall, 121 N LaSalle. Please submit any feedback on the revised plan via the Zoning Feedback Form by Monday Feb. 10th, 2020, so that we can provide the Zoning Committee with a timely Aldermanic response to the amended submission.
